Welcome to PhotoFix: Colorize & Enhance (the “App”, “we”, “us”, or “our”). By downloading or using the App you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the App.

You may use the App for personal, non-commercial purposes only, and only for photos you own or have the legal right to modify. You must comply with all applicable laws when using the App. Do not attempt to access or use the App by any means other than the provided user interface.

4. Intellectual Property

4.1 Your Content

You retain ownership of the photos you upload. By submitting images, you grant us a limited, non-exclusive, worldwide license to process, temporarily store, and return enhanced images to provide the services. Processed images are intended for your personal use unless otherwise agreed in writing.

4.2 Our Content

The App, including all designs, code, algorithms, and related intellectual property, is owned by us or our licensors and is protected by law. No rights are granted except as expressly stated in these Terms.

5. Privacy

Your privacy is important. Our Privacy Policy explains how we collect, use, and protect information. If the App collects device identifiers or other tracking data, such uses will be disclosed and handled in accordance with Apple’s App Store requirements and the Privacy Policy.

6. Subscriptions & Payments

Some features are free; others require payment via a subscription. Subscription terms are shown in the App. All billing is handled through your Apple ID and is subject to Apple’s payment and refund policies.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions through your Apple ID account settings.

7. AI Limitations & Accuracy

AI-based restoration and colorization are approximate and results vary depending on the source image quality and condition. While we aim for high-quality outcomes, we cannot guarantee specific results.

8. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties including merchantability and fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total aggregate liability for claims related to the App is limited to the amount you paid us in the 12 months prior to the claim (if any).

10. Termination

You may stop using the App at any time. We may suspend or terminate access if we believe these Terms have been violated or for other lawful reasons. Upon termination, your rights to use the App cease.

11. Changes to These Terms

We may update these Terms occasionally. We will post the revised Terms within the App or on this page and indicate an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of your country of residence. Disputes will be resolved in the courts of that jurisdiction unless arbitration is required by applicable law.

13. Severability

If any provision is held unenforceable, the remaining provisions will remain in effect.

14. Feedback

Any feedback, ideas, or suggestions you submit may be used by us without compensation and become our sole property, subject to applicable law.
